Texas Governor Vetoes Bill to Ban THC Products

Last month, Texas Governor Greg Abbott vetoed Senate Bill 3 moments before the deadline. SB 3 aimed to ban the sale of hemp products that contain THC in the state. Had SB 3 completed its journey through the Texas House, THC products would not be allowed to be sold anywhere in Texas.

“Texans on each side of the Senate Bill 3 debate raise serious concerns,” Governor Abbott said in a news release. “But one thing is clear—to ensure the highest level of safety for minors, as well as for adults, who obtain a product more dangerous than what they expected, Texas must strongly regulate hemp, and it must do so immediately.”

SB 3 was a significant priority for some lawmakers, including Lt. Gov. Dan Patrick, but faced strong opposition from the hemp industry and consumers who rely on THC products. Following the veto, Governor Abbott called a special legislative session, which is scheduled to begin on July 21st, 2025, to address the regulation of THC products in the state.

“We respect Governor Abbott’s decision and understand his concerns about unintended consequences,” said Jason Vedadi, a Texas native and CEO of Story Cannabis. “That said, the rapid proliferation of high‑potency hemp products in Texas has highlighted a regulatory gap that simply can’t be ignored. I hope this signals a renewed commitment to crafting thoughtful legislation that effectively addresses public health and youth protection, without undermining safety.”

“While the bill’s failure may offer a short-term reprieve for the hemp industry, it leaves Texans exposed to a marketplace flooded with potent THC products that often evade testing and age restrictions,” added David Craig, chief marketing officer of Illicit Gardens. “This is not a sustainable model. The intention behind SB 3 was to put reasonable boundaries in place, and I believe that conversation is far from over. Lawmakers and regulators now have an opportunity to come back to the table and design a smarter framework that reflects the reality of today’s cannabinoid market and prioritizes long-term public health.”
